The Supreme Court has said it will not go into personal laws while dealing with a batch of petitions seeking legalisation of same-sex marriage. The 5-judge Constitution bench said that it will confine the hearings on Special Marriage Act. The bench said that the issues are complex and said the very notion of a man and a woman, as referred to in the Special Marriage Act, is not “an absolute based on genitals". Solicitor General Tushar Mehta, appearing for the Centre, said the the conferment of socio-legal status of marriage cannot be done through judicial decisions. It cannot even be done by the legislature.
